Tips from a DUI Lawyer on What To Do When Pulled Over

April 17, 2017

Driving under the influence of alcohol or drugs will typically result in needing a DUI lawyer. While this may sound a bit gloomy, the truth is that people who get away with driving under the influence once or twice tend to get more confident. Eventually, these people see the flashing lights in their rear-view mirror.

The reality is that the only way to avoid needing a DUI attorney is to not drive intoxicated. With a culture that promotes having a drink, or several, there is a good chance that most people can benefit from knowing how to reach an attorney at some point in their life. Here are a few tips, to avoid making the situation worse in the event of a DUI stop.

Always cooperate

There is a lot of advice out there on the internet talking about not cooperating with a police officer in any number of situations. In almost all situations, it is neither wise nor beneficial to not cooperate with a police officer. Especially, in a situation where the driver is under the influence of drugs or alcohol.

As a DUI lawyer, building a defense for a client with additional charges because they decided to resist arrest, takes my attention away from addressing the DUI charges themselves. While I can handle this situation, it is easier to negotiate when there is one charge, versus many, and potentially get a plea bargain.

Call the attorney

The last thing that a person wants to do is sit in a detox jail cell for a length of time. The easiest way to work through this is to call a DUI lawyer who can make their way down and figure out how to get the person out of jail as quickly as possible. In addition, having an attorney present will ensure that the person in jail who was arrested for DUI, will have all of their rights protected.

Most DUI cases, unless they involve additional circumstances, can be handled relatively easily by a good attorney when they are quickly notified and can take stock of the situation early in the process.

Let the attorney do the talking

The biggest mistake people make is talking excessively after being arrested. I understand it is easy to have loose lips after having too much to drink, and when faced with a lot of uniforms and handcuffs, but it is in the best interest of anybody charged with a crime to say as little as possible until their attorney can get on the scene.

There are a lot of things that can be challenged, including the results of the blood alcohol tests. However, let the attorney do the talking for you. That is my job.

Don’t drink and drive

This may sound like strange advice coming from a DUI attorney, but the reality is that drunk drivers make the streets less safe for all of us. The best way to avoid needing to hire me is to not drink and drive, get a designated driver, or simply stay put until the alcohol has had enough time to work its way out of the system. However, if you ever are arrested, I would be happy to provide legal representation and welcome the phone call.
